BIKE PARK KUBÍNSKA HOĽA – OPERATING RULES

GENERAL PROVISIONS

These operating rules define the conditions and regulations for using the BIKE PARK at the Kubínska hoľa resort (hereinafter referred to as the “BIKE PARK”), which includes the following trails: 1. Downhill, 2. Enduro, 3. A-line, 4. Super Mix (hereinafter referred to as the “trail” or “trails”).

The operator and owner of the BIKE PARK is ORAVA SKIPARK, a.s., registered office: 027 41 Oravský Podzámok 381, Company ID: 44 716 028, registered in the Commercial Register of the District Court Žilina, Section Sa, Insert No. 10675/L (hereinafter referred to as the “resort” or “operator”).

The terms and conditions for services at the Kubínska hoľa resort are governed by the General Terms and Conditions (GTC), which take precedence over these operating rules. Visitors (hereinafter “user”, “cyclist”) are required to familiarize themselves with the GTC, available at ticket offices, at the trail start, or on kubinska.sk, and comply with them.

RULES FOR ACCESS TO THE BIKE PARK
- Access of the user to the BIKE PARK trails is permitted only with a valid ticket for cyclists. By purchasing the ticket, the user confirms that they have been acquainted with these operating rules, understand them, and agree to them.
- Each user is obliged to comply with all orders, prohibitions, and instructions stated on signs placed within the BIKE PARK area, as well as verbal instructions given by the resort staff.
- In the event of a breach of regulations, particularly conduct that endangers the safety of the user, other persons, or property, as well as failure to follow the instructions of the resort staff, the user may be requested to immediately leave the BIKE PARK, and their ticket may be blocked by the operator without any entitlement to a refund.
- The user shall be liable to the operator and other users for conduct in violation of these rules, including damage or destruction of property, damage to equipment or facilities of the BIKE PARK, or injury to health.
- The provisions of these rules shall also apply in cases where the user uses the trail in connection with sports competitions or during such competitions, taking into account the rules provided by the organizers of such events.
- The user acknowledges that downhill, enduro, and freeride, as specific forms of mountain biking, are extreme sports requiring high physical and mental fitness, adequate skills, and appropriate equipment, including protective gear, especially helmets and body protection. Beginners are advised to ride with an instructor.

RULES FOR USING BIKE PARK TRAILS
- Access to BIKE PARK trails is permitted only with valid tickets intended for cyclists, purchased at the ticket offices of the Kubínska hoľa resort or via the ESKIPASS e-shop (https://kubinska.eskipass.sk). Users, together with their bicycles, are transported to the start of the trails by chairlift. The current price list is available on kubinska.sk and at the resort ticket offices. Tickets are issued on chip cards.
- The user is obliged to carry a valid ticket at all times while using the BIKE PARK trails.
- All types of tickets are non-transferable. Ticket usage is monitored. A photograph of the ticket user is taken at each passage through the turnstile for control purposes. Tickets purchased from other persons are invalid and will be blocked upon use. Upon request of the resort staff, the user is obliged to present their ticket for inspection. Refusal to do so may result in blocking the ticket and exclusion from the BIKE PARK and transport by chairlift without entitlement to a refund.
- Trails are accessible only during the operating hours of the resort, as stated on kubinska.sk and at the ticket offices. The operator may adjust operating hours due to adverse weather conditions, poor visibility, technical condition of the trails, or maintenance requirements.
- The operator may temporarily restrict access to trails for organizational reasons, in particular due to competitions, training sessions, or events.
- Information about technical breaks, changes in operating hours, or trail closures is published in advance on kubinska.sk and at the ticket offices.
- The use of closed trails or sections is strictly prohibited, even with a valid ticket.
- By purchasing a ticket and entering the BIKE PARK trails, the user acknowledges that they use the trails at their own risk and responsibility and is obliged to pay due attention to the protection of their own life and health, as well as that of others. The operator shall not be liable for any damage to property or health. Persons under 18 years of age are prohibited from entering the trails unless they have written consent from a parent or legal guardian. Persons under 15 years of age may enter the trails only when accompanied by a parent.

It is strictly prohibited within the BIKE PARK:
a) to smoke, consume alcohol or narcotic substances, or use the trails under their influence,
b) for minors to enter without supervision,
c) for pedestrians to use the trails,
d) to bring and use dangerous objects (e.g. knives, rods) or items made of fragile, sharp, or hard materials (e.g. glass, metal),
e) to move with dogs, horses, or other animals,
f) to use vehicles other than bicycles intended for mountain biking (downhill, freeride, enduro, MTB, XCO, etc.),
g) to make fire,
h) to litter,
i) to damage BIKE PARK infrastructure, including dismantling or modifying equipment, graffiti, stickers, or damaging safety elements,
j) to move in the opposite direction, stop in unsafe places, or leave bicycles on the trail,
k) to place or distribute advertising materials without prior consent of the operator,
l) to conduct commercial or professional activities (including instruction or training) without prior written consent of the operator. -
The operator is entitled to exclude any person violating these rules and block their ticket without refund.

Users violating these rules or the GTC shall be fully liable for any damage caused.

SAFETY INFORMATION AND HEALTH PROTECTION

Downhill, freeride, enduro, and mountain biking (MTB) are high-risk sports. The use of cycling trails, even by individuals in full physical condition, may result in damage to equipment, injury to health, or even loss of life.

Before using a trail, the user is obliged to familiarize themselves with the trail and its obstacles and ensure that there are no health or technical contraindications for themselves or for minors under their supervision for downhill, freeride, enduro, and MTB activities.

The trails are one-way; the cyclist must ride in the designated direction from start to finish and comply with the markings of each trail.

The user is obliged to exercise particular caution while riding, maintain a safe distance from the rider ahead, and adjust their speed to their abilities, the condition of the trail and its obstacles, current weather conditions, and the number of users on the trail, so as to leave sufficient space for other users.

A user who has entered the cycling trail is obliged to stop in a manner that does not endanger or restrict other users. If the user wishes to continue riding after stopping, they must ensure that doing so does not endanger themselves or other cyclists.

The user must not overestimate their abilities and should take into account their age, physical condition, and the possible decline in physical performance due to fatigue, even if the use of the trail has been interrupted for rest.

Users of the BIKE PARK are obliged to use all functional protective equipment intended for mountain biking downhill disciplines, meeting generally applicable safety standards specified by the manufacturer, including: a) certified helmet, b) limb protectors (arms and legs), c) protective gloves, d) spine and chest protectors.

Cyclists should be aware that natural obstacles may occur on the trails without the operator’s knowledge, such as muddy or slippery surfaces, terrain collapses, landslides, etc. Trees or branches may also fall onto the trail, especially in windy conditions.

Each cyclist is obliged to immediately report to the resort staff any obstacles, damage, or other circumstances on the trail that may endanger safety, including dangerous behavior of other users. In the event of an accident on the trail, the cyclist is obliged to provide assistance and report the incident to an authorized person. Authorized persons are resort staff, and reporting points include any valley or upper station of the chairlift, or by phone: +421 918 830 065 – ticket office. In very serious cases, contact the Mountain Rescue Service emergency line 18 300 or the general emergency number 112. The cost of Mountain Rescue Service intervention is not included in the ticket price; therefore, we recommend considering additional insurance for mountain activities and rescue services.
FINAL PROVISIONS
- These rules are available at ticket offices, trail starts, and kubinska.sk.
- These rules are valid from May 1, 2023 until further notice.
- The operator reserves the right to amend and supplement these operating rules. Any changes shall become effective on the date of their publication at the resort ticket offices, at the trail start, and on the website kubinska.sk.
